Which Personal Data are collected and for which purposes are they processed?

  • Simple browsing of the Website does not involve the collection of any type of Personal Data by Venice Luxury Boat. The Website’s IT systems collect only certain technical data whose transmission is implicit in the use of Internet communication protocols. Such information is not collected to be associated with you, but by its nature may, through processing and association with data held by third parties, allow identification only where necessary in connection with the commission of unlawful acts. These data are used to obtain anonymous statistical information on the use of the Website and to check its correct functioning; to enable—given the architecture of the systems used—the proper provision of the various features you request; for security reasons and for the verification of liability in the event of alleged computer crimes to the detriment of the Website or third parties. They will be stored for the time necessary to pursue the purposes for which they were collected, unless a longer retention period is required for the defence or exercise of rights.
  • Through the Website, you may also voluntarily provide Personal Data and, in particular:
    1. Data used for the purchase and delivery of Venice Luxury Boat products, including identification data (first and last name), contact data (telephone number, email address, home address or delivery address if different from home address, billing address), [payment data and other banking information that will be acquired by the Controller only in the event of payment by bank transfer (as contained in payment receipts/accounting records)], other data (e.g., company name, VAT number).
    2. Identification data (first and last name) and contact data (email address) used for newsletter subscription, through the forms available on the Website pages.
  • Please note that, within the product purchase procedure on the Website, you may freely provide consent to the processing of the Personal Data you provide for the following purposes:
    • subscription to the newsletter service to receive promotional communications and updates on Venice Luxury Boat’s activities;
    • sharing your email address with third parties for the sending of “personalised” commercial communications relating to advertising relevant to your interests via social media networks.
    Venice Luxury Boat will process such Personal Data in compliance with applicable law, assuming that the data relate to you or to third parties who have expressly authorised you to provide them.
  • Information on the use of Cookies is available in the Cookie Policy set out in the dedicated section of this notice. At any time, you may change/manage your consent preferences for the purposes described in this Notice, or exercise the rights granted by the GDPR, as described in the “Contact the Controller” section of this Notice. The Personal Data of Users processed by Venice Luxury Boat are collected for the following purposes:

How are Personal Data processed?

Personal Data may be freely provided by you or, in the case of browsing data, collected automatically during your use of the Website. Where specified in the forms on the Website pages (data marked with an asterisk), providing Personal Data is necessary in order to provide the requested service (e.g., purchase of a service): if you refuse to provide such data, it may be impossible to fulfil your request. Conversely, with regard to Personal Data not marked as mandatory, you are free not to provide them, without any consequence on the availability of services or the operation of the Website. Providing your Personal Data for newsletter subscription and for sending promotional communications, including personalised communications, is optional: you may decide not to give your explicit consent, or to withdraw it at any time. If you do not give specific consent to processing, Venice Luxury Boat will not be able to carry out the above activities. It may also occur that you provide Venice Luxury Boat with Personal Data relating to third parties, resulting in incidental processing of such third-party data. In such cases, you qualify as an independent data controller and assume all related legal obligations and responsibilities. Accordingly, you undertake to hold Venice Luxury Boat harmless from any dispute, claim, request for damages, etc. that may be brought against Venice Luxury Boat by third parties whose Personal Data have been processed through your unsolicited submission in breach of applicable data protection rules. In any event, if you provide or otherwise process third-party Personal Data, you undertake—assuming all related responsibility—to ensure that such processing is based on an appropriate legal basis under Article 6 of the GDPR. Your Personal Data are processed by the Controller in accordance with applicable law, in compliance with the principles of lawfulness, fairness, transparency, purpose and storage limitation, data minimisation, accuracy, integrity and confidentiality set out in the GDPR. Appropriate technical and organisational measures have been adopted to ensure the security of your Personal Data, taking into account the state of the art and implementation costs, as well as the nature, scope, context and purposes of the processing, and the risks (of varying likelihood and severity) to rights and freedoms arising from the processing activities described in this Notice.

Such parties have been appointed by the Company as Data Processors pursuant to Article 28 of the GDPR and have received specific instructions from the Controller for the correct processing of Personal Data. The list of Data Processors may be requested from the Controller as described in the “Contact the Controller” section. Subject to your consent, the email address you provide for the purchase of products through the Website and/or for subscribing to Venice Luxury Boat’s newsletter may be shared with third parties (social media service providers) in order to improve the relevance of advertising directed at you. Finally, Personal Data may be disclosed to private entities and public authorities that are entitled to access them under laws or measures issued by competent authorities. Personal Data may be transferred outside the European Economic Area only to entities bound by standard European contractual clauses permitted under Article 26(2) of Directive 95/46/EC, or where the territory in which processing takes place has been deemed adequate by the European Commission pursuant to Article 25(6) of Directive 95/46/EC, or in the other cases provided for by Articles 44 et seq. of the GDPR.

How long will the data be stored?

Personal Data provided for newsletter subscription and for sending commercial communications will be stored for 24 months from the date of last contact, unless consent is withdrawn earlier or renewed upon expiry of the above period. After the periods indicated, the data will be deleted or anonymised, unless the Company is required to retain the Personal Data for longer periods to comply with legal or regulatory obligations, or where necessary for the resolution of disputes/pre-disputes or judicial proceedings.

Thanks to cookies, a website can remember a user’s actions and preferences (such as login data, chosen language, font size, other display settings, etc.) so that they do not need to be set again when the user returns to the website or navigates from one page to another. Cookies are therefore used to perform IT authentication, session monitoring and storage of information regarding users’ activities on a website, and may also contain a unique identifier code that enables tracking of the user’s browsing within the website for statistical or advertising purposes.
